3. Purpose of Data Collection

The Company collects and processes information strictly for:

  • Service delivery and platform functionality;
  • Academic quality monitoring and performance evaluation;
  • Teacher verification, onboarding, payroll, and compliance;
  • Legal, regulatory, and contractual obligations;

4. STRICT CONFIDENTIALITY OBLIGATIONS – TEACHERS & PROFESSIONALS

4.1 Confidential Information

Teachers and working professionals acknowledge that they may receive access to:

  • Course materials, curriculum, training content;
  • Internal business information, processes, pricing, strategies;
  • Platform data, recordings, analytics, and proprietary tools.

All such information shall be treated as strictly confidential.

4.2 Prohibited Conduct (Teachers & Professionals)

Teachers, instructors, employees, freelancers, and consultants shall not, during or after association with the Company:

  • Copy, record, store, download, or distribute student data or content;
  • Share class recordings, materials, or internal data with third parties;
  • Use student or parent contact details for personal, commercial, or external purposes;
  • Solicit students or parents outside the Platform;
  • Reuse, resell, or reproduce Company content, curriculum, or teaching frameworks;
  • Represent themselves as independent providers of Spikitech programs.

Any breach shall be treated as a material breach of contract.

5. Monitoring, Recording & Surveillance

5.1

The Company reserves the absolute right to:

  • Monitor platform activity, communications, and login behavior;
  • Record live classes, calls, chats, and sessions;
  • Audit performance and compliance of teachers and professionals.

5.2

Such monitoring shall be deemed lawful, consented, and necessary for quality control, security, and legal compliance.

6. Data Sharing & Disclosure

The Company may disclose information:

  • To payment gateways, hosting providers, and IT partners;
  • To government authorities, courts, or law enforcement when required by law;
  • For investigation of fraud, misconduct, or contractual breach.

The Company shall not be liable for disclosures mandated by law.

7. Data Retention

7.1

The Company may retain personal and professional data:

  • Even after termination of association, where legally necessary.

Teachers and professionals do not have the right to demand deletion of data required for compliance, audits, or dispute resolution.

The Company implements reasonable administrative, technical, and organizational safeguards. However, no system is completely secure, and the Company disclaims liability for unauthorized access beyond reasonable control.

9. Breach, Misuse & Legal Action

Any misuse, unauthorized disclosure, or data breach by a teacher or professional shall entitle the Company to:

  • Immediate termination without notice;
  • Forfeiture of pending payments (where legally permissible);
  • Civil and criminal proceedings;
  • Injunctive relief and damages.

The Company reserves all rights under Indian law.

10. No Ownership Rights

All data, content, recordings, materials, analytics, and information collected or generated on the Platform remain the exclusive property of Spikitech Private Limited. No user, teacher, or professional acquires any ownership rights.

11. Limitation of Liability

The Company shall not be liable for:

  • Personal misuse of data by third parties beyond reasonable control;
  • Losses arising from user negligence;
  • Consequential or indirect damages.

12. Changes to Privacy Policy

The Company reserves the unilateral right to modify this Policy at any time. Continued association or use of the Platform constitutes acceptance of the revised Policy.

13. Governing Law & Jurisdiction

This Policy shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of competent courts in India.
